Terms and Conditions

These Terms and Conditions ("Terms") govern your use of speedcigars.com (the "Site") and any purchase you make from Speed Fuel Corp, a New Jersey corporation located at 344 E State Rt. 4, Paramus, NJ 07652 ("Speed Cigars", "we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility: adults 21+ only

1.1 You must be at least 21 years old, or older if the law where you live requires it, to purchase from us. 1.2 You confirm that the information you give us, including your name, date of birth and addresses, is true and complete. You also confirm that you are buying for your own personal use, not for resale and not for anyone under 21. 1.3 We sell only to addresses in the states listed in our Shipping Policy. You are responsible for making sure that receiving the products is lawful where you live.

2. Age and identity verification

We verify age through a third-party verification service before an order ships. If that check cannot confirm your age, we may ask for a copy of a government-issued photo ID. Every delivery requires the signature of an adult aged 21 or older who shows photo ID. We cancel and fully refund any order we cannot verify. Any attempt to get around age verification is prohibited, including through automated tools, agents or third-party checkout services.

3. Products

3.1 We sell handmade premium cigars and related items. Product details such as size, ring gauge, count, origin and wrapper come from manufacturers or distributors. We work to keep them accurate, but errors can occur, and packaging may change without notice. 3.2 Strength and flavor descriptions are general descriptors only. They are not a promise of how a cigar will taste to you. 3.3 We make no health claims about any product. No cigar is safe, and no cigar should be considered less harmful than any other tobacco product. 3.4 Product images are for illustration only.

4. Prices and payment

4.1 Prices are in US dollars and can change without notice. If an item is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund you, even after we have sent an order confirmation. 4.2 Payment is processed by our third-party payment processors. We do not store full card numbers. Charges appear on your statement as SPEEDCIGARS.COM. 4.3 We collect sales tax where we are required to. You are responsible for any other taxes your state or locality imposes on your purchase that we do not collect. 4.4 Quantities may be limited, and we may limit or refuse any order.

5. Order acceptance

Your order confirmation email confirms that we received your order. It does not mean we have accepted it. An order is accepted when it ships. We may refuse or cancel any order, for example when age verification fails, we suspect fraud, an item is out of stock, there is a pricing error, or shipping to the address is not permitted. If we cancel an order after charging you, we refund the full amount.

6. Shipping, title and risk of loss

Shipping is covered by our Shipping Policy, which forms part of these Terms. Title and risk of loss pass to you when we hand your order to the carrier in New Jersey. We will still help you with carrier claims as described in the Shipping Policy.

7. Returns and refunds

Returns and refunds are covered by our Return & Refund Policy, which forms part of these Terms.

8. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us right away if you believe your account has been used without permission.

9. Reviews and user content

When you submit a review or other content, you give us a non-exclusive, royalty-free license to display it on the Site. Reviews must be truthful, based on your own experience, and must not contain health claims or unlawful content. We do not alter reviews to change their meaning, and we do not suppress reviews because they are negative. We may remove content that breaks these rules.

10. Prohibited uses

You may not use the Site if you are under 21. You may not buy for resale, place fraudulent orders, get around age verification, scrape or overload the Site, interfere with its security, or use it for any unlawful purpose.

11. Intellectual property

The Site's content, design and Speed Cigars branding belong to us or our licensors. Third-party brand names and logos belong to their owners and are used only to identify the products we sell.

12. Disclaimers

Except as stated in these Terms and to the extent the law allows, the Site and products are provided "as is" and "as available". We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the extent the law allows. Nothing in these Terms limits any right you have that cannot be waived under applicable law.

13. Limitation of liability

To the extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages. Some jurisdictions do not allow some of these limitations, so they may not apply to you. These limitations do not apply to liability that cannot be limited by law.

14. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Site, including false age or identity information. This applies to the extent the law allows.

15. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Bergen County, New Jersey, and you and we consent to their jurisdiction. This does not affect any right you have to bring a claim in small claims court or any non-waivable rights you have as a consumer.

16. Privacy

Our Privacy Policy explains how we collect and use personal information, including data used for age verification.

17. Changes

We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order.

18. Severability

If any part of these Terms is found unenforceable, the rest remains in effect.
